"Human in the loop" is a common line in AI-for-media pitches. For one kind of content, since 2 August 2026, the EU AI Act gives it a legal edge. Article 50(4) of the AI Act sets a disclosure duty for one kind of content: AI-generated or manipulated text published to inform the public on matters of public interest. It also has an exception that turns on who stands behind the text. A publisher that cannot show the exception applies may have a disclosure duty. Not all AI text is covered.
What Article 50(4) says
Article 50(4) covers deployers of an AI system "that generates or manipulates text which is published with the purpose of informing the public on matters of public interest". Those deployers must disclose that the text was artificially generated or manipulated.
There is an exception. The duty does not apply where "the AI-generated content has undergone a process of human review or editorial control and where a natural or legal person holds editorial responsibility for the publication of the content." (Article 50 text, AI Act Service Desk.)
Read it twice. The exception has two parts, joined by "and":
- The content has undergone a process of human review or editorial control.
- A natural or legal person holds editorial responsibility for the publication of the content.
A quick skim is not obviously a process of review. And a process is a different thing from someone who holds responsibility for publishing. The text does not say how much review is enough; that is for the guidelines, regulators and counsel to settle.
When it applies
The Commission says Article 50 applies from 2 August 2026, and that enforcement of the AI Act, including these transparency rules, begins on that date (Commission press release, 31 July 2026). It has also published guidelines on the transparency obligations. Their description lists "AI-generated text on matters of public interest" and exceptions such as "standard editing" among the topics covered.
None of this is legal advice. The guidelines and your counsel decide how it applies to a given publisher and workflow. Meeting the exception is a legal question about the facts, and nothing below guarantees it.
Where the exception gets tested
Take the automation that already exists. In its first year, the Washington Post's Heliograf produced around 850 articles, about 500 of them around the 2016 election, many of them stories "the Post wasn't going to dedicate staff to anyway" (Digiday via Nieman Lab, 2017). That is high-volume, narrow output. Whether a given item like that has "human review or editorial control" is the kind of question the clause raises. We make no claim about how it applies to Heliograf; the answer would depend on how the process is run and on the law, not on the tool.
Now a different case. When OpenAI agreed in January 2025 to fund four new Axios Local newsrooms, Axios's leadership told staff the technology would not be used to report stories, "but to help build a system for creation, distribution, and monetization of our journalism" (Axios, 15 January 2025). Axios describes its local newsletters as written by on-the-ground reporters.
These two cases do not show which approach complies. They only show a range of practice. An operator should know where it sits on that range and be able to document it.
Our reading: four checks (Hlinor recommendations)
"Human in the loop" is weak as a control when it is a habit instead of a rule. The AI Act does not list the four checks below, and doing them does not guarantee the exception applies. They are Hlinor's practical recommendations for teams whose agents draft and publish, meant to make the two statutory conditions easier to show:
- Approval is a gate, not a courtesy. For the content your policy puts in scope, the agent cannot publish without a recorded approval.
- Responsibility is assigned. A natural or legal person holds editorial responsibility for each channel, and that is recorded.
- Review is evidenced. A log shows what the human saw and what they changed or accepted.
- Scope is explicit. Your own written policy says what the agent may publish alone and what needs approval. That line is your policy choice, not a legal exemption by subject: a short, routine item can still be text published to inform the public, so check it against Article 50(4) with counsel before treating any category as outside it.
That is a delegation boundary: automate what can be undone or checked cheaply, and assign a responsible person to the rest. An instruction to publish is not an authorization to publish.
What we did not rely on
Many widely repeated statistics in this area did not trace to a primary source when we checked them: error-rate drops credited to a named outlet's "AI sandbox", a per-token price floor, video artifact rates. We left them out. If a number matters to your decision, ask for the source, not the retelling.
