A lot of people in tech eventually ask the same question. If I build something big here or sell a company, is there a way to live and work in the US without an employer holding my status hostage? Two investor routes keep coming up in that conversation, and they work very differently.
Immigration Win, a site focused on visa and green card guides, has a clear US Golden Visa explainer that compares both programs side by side, with breakdowns of requirements, timelines, and family inclusion. I read it, then checked the key points against public reporting and law firm alerts. Here is the plain version, with a few cautions.
*First, the name is unofficial
*
“Golden visa” is not a legal term in the US. People use it for any route that gives a green card in return for money. Right now that mostly means two things: the long-running EB-5 program and the newer Gold Card.
Both lead to lawful permanent residence. Neither is a shortcut around background checks, and neither is a guarantee. Think of them as two different deals with very different risk profiles.
*How EB-5 works
*
Congress created EB-5 in 1990. You invest in a new commercial enterprise that creates at least 10 full-time jobs for US workers. As of this writing, the minimum is $800,000 in a targeted employment area, such as a rural or high-unemployment zone, and $1,050,000 elsewhere.
Most investors go through a regional center, where a professional team runs the project. The steps look like this:
Choose a project. Research the regional center’s track record and finances.
Invest and document. You must trace every dollar back to a lawful source.
File Form I-526E. This proves your investment and your source of funds.
Get a conditional green card. It lasts two years, and your spouse and unmarried kids under 21 are included.
File Form I-829. You show the jobs were created, and the conditions come off.
The investment must be truly at risk. Projects can underperform or fail, so due diligence matters a lot.
*How the Gold Card works
*
The Gold Card came from an executive order signed in late 2025, and USCIS posted Form I-140G for it. Based on public reporting, the program asks for a $15,000 processing fee and a $1 million contribution to the US government for an individual. A company sponsoring someone is reported to pay $2 million.
The key difference is that this is a contribution, not an investment. You do not create jobs or manage a business. But you also do not get the money back.
**Side by side
**Feature EB-5 (targeted area) Gold Card
Minimum amount $800,000 investment, plus fees $1 million contribution, plus $15,000 fee
Money returned? Possible, but not guaranteed No
Jobs required? Yes, 10 full-time jobs No
Legal basis Federal law, in place since 1990 Executive order
Track record Long, with known processes New, with fewer precedents
Family included? Spouse and kids under 21 Check current USCIS rules
The legal basis row is the one many people skip. EB-5 sits in federal statute. The Gold Card rests on executive action, and immigration attorneys have pointed out that a future administration could change or end it. That does not make it a bad option, but it is a different level of certainty.
*Timelines: be skeptical of any single number
*
USCIS has said Gold Card processing should take weeks once the fee and application arrive. Some practitioners say it could take much longer in certain cases. One concern lawyers raise is that applicants from countries with long green card backlogs, such as India, may still wait behind other applicants, even after paying.
EB-5 timelines have been long too. The I-526E stage alone has often taken a year or more, and then there is the visa stage and the I-829 stage after that. Your country of birth can change the picture a lot.
So when a site gives you a neat “3 to 6 months” or “4 to 6 years,” treat it as a rough guess. Check current USCIS processing data and the monthly visa bulletin for your country.
*Costs beyond the headline number
*
Neither route is just the sticker price. EB-5 has filing fees, legal fees, and often administrative fees charged by the project. The Gold Card has the processing fee and possibly small additional government fees.
You also need to think about tax. The US taxes green card holders on worldwide income. That can change how you handle foreign income, trusts, and companies, so a US tax professional should be part of your planning from the start.
Who might lean which way
If you want the chance to get capital back and are comfortable with investment risk and a longer process, EB-5 may fit better. It has an established legal structure and many years of case history behind it.
If you prefer a simpler process with no job-creation tracking, and you can afford a contribution you will not recover, the Gold Card may appeal. Just be ready for policy risk and fewer precedents. In both cases, the right answer depends on your country, your finances, and your goals.
Before you spend anything
*A few steps are worth doing first:
*
Read the official USCIS pages for each program, not only blog summaries.
Ask for a written breakdown of every fee, including legal and project costs.
Check how your birth country affects visa availability.
Verify any regional center or advisor independently, since investor immigration attracts scams.
Talk to a licensed immigration attorney who is not paid based on which program you pick.
I am not a lawyer, and this is not legal advice. Rules in this area change quickly, so confirm every figure against current official sources.
*The takeaway
*
EB-5 and the Gold Card both offer a route to permanent residence, but they trade off cost, risk, and certainty in very different ways. One is an investment with a long track record. The other is a new contribution program with a faster promise and a thinner safety net. Do the homework, get independent advice, and treat every timeline you read online, including these, as a starting point.
