Every trademark office publishes. None of them email you.
That is the whole problem in one line. If you own a brand, you can find out that someone filed a confusingly similar mark, but only if you go and look. Nothing arrives in your inbox. No office has a notification list. The register is public and the job of watching it belongs to you.
I have spent a few years building watch setups against this data, so this is a practical write up of what the data actually looks like and where a home made watch breaks.
What the offices give you
Most national offices expose new applications in some machine readable shape. The US publishes a weekly gazette plus bulk XML and JSON. EUIPO and WIPO publish daily. TMview aggregates a large set of offices into one searchable index, and its API is the closest thing to a single source you can pull.
Three things about this data surprise people the first time they touch it.
The publication date is not the filing date. A US application can sit for months before it publishes. You are watching a delayed feed, so any alert you get is already old news. That is normal and it is still early enough to act, because the clock that matters starts at publication, not filing.
The clock is short. In the US you generally have 30 days from publication to oppose. In the EU the window is usually 3 months from publication. Miss it and your options move from a form to a proceeding, which is a different order of cost.
Status is a moving target. A record you pull today can change tomorrow. If you do not keep a copy of what you saw and when, you cannot later show what you knew and when you knew it. Log the record, the date and the payload hash.
The matching problem is the real work
Exact string matching is trivial and close to useless. The filings that hurt are the ones that are not exact.
Spelling variants. One letter moved, one doubled letter, a plural. A rule based fuzzy match on edit distance catches a lot of these and produces false positives at roughly the same rate, so you need the class information to cut the noise.
Phonetic variants. A mark that sounds like yours when spoken is a genuine conflict in most jurisdictions, and it will never show up in a substring search. Double Metaphone or a similar phonetic key gets you most of the way there.
Transliteration. If your mark travels between Latin and Cyrillic or Latin and Greek, you need a transliteration layer before the comparison, otherwise you are comparing two scripts that a customer reads the same way.
Class overlap. Comparing a mark in class 25 against yours in class 42 is mostly noise. Comparing it in the same class, or in a class that is complementary to your goods and services, is where the signal is. The office hands you the Nice classes. Use them as a filter, not as an afterthought.
A watch you can actually keep running
The shape that survives contact with reality is boring.
Pull the new records on a schedule. Diff against the previous run so you only look at what is new. Score each new record on text similarity plus class overlap. Store the ones above a threshold with the office record link. Send yourself a summary, not a live feed.
The failure mode is not coverage. It is that a human stops reading the alerts after two weeks of noise. Tune the threshold until the summary has one or two items you actually want to open. A watch nobody reads is worth zero, no matter how many registers it covers.
The other failure mode is coverage in the other direction. Pulling from one office feels like you are covered until a filing lands in a market you sell into but never registered in.
Where this sits next to a lawyer
Monitoring tells you that something happened and hands you the record. It does not tell you what to do about it, and it should not. Whether a filing is worth opposing is a legal judgement about your rights, the goods and services, and the cost of the fight. What a watch does is make sure you arrive at that conversation with the filing in hand and time still on the clock, instead of finding out from a customer.
If you want to see how a commercial watch is structured against a home made script, there is a side by side comparison here that covers what each one actually does with the data. Nothing on this page is legal advice, and a conflicting filing is a question for your trademark counsel.
