Key Takeaways
- SIMA anti-dumping duties are assessed on top of MFN tariff rates and can range from single digits to over 200%, depending on the exporter and product.
- Once CBSA opens a SIMA investigation, provisional duties apply immediately to all future imports of subject goods, forcing you to post security or pay upfront at the border.
- Your RPP bond calculation must include potential anti-dumping and countervailing duty exposure if you import from countries under active SIMA cases.
- Warehouse inventory already in Canada before a SIMA order takes effect is not retroactively assessed, but anything released after the order date is subject to the full margin.
Carrier Surcharges Are Visible. Anti-Dumping Duties Canada Imposes Are Not—Until They Double Your Landed Cost.
FedEx just announced demand surcharges on U.S.-bound volume from Canada, Europe, and China ahead of peak season. Importers see the line item, add it to the cost stack, and move on. Anti-dumping duties Canada levies through the Special Import Measures Act work differently. They appear without warning, apply retroactively to goods already in transit, and stay in force for five years or longer. If you import steel, aluminum, gypsum board, certain chemicals, or any of the 150+ product categories under active SIMA cases, the margin can exceed the base tariff by multiples.
Carrier fees are negotiable. SIMA margins are not. Here's how the system works, what triggers a case, and what it means for your customs brokerage cadence and CARM Client Portal workflow.
What SIMA Anti-Dumping Duties Are and How CBSA Applies Them
The Special Import Measures Act gives CBSA authority to impose anti-dumping (AD) and countervailing (CVD) duties when foreign goods are sold into Canada below normal value or benefit from unfair subsidies, and a Canadian industry is materially injured. The process starts with a domestic producer filing a complaint. CBSA has 105 days to investigate. If the evidence meets the threshold, provisional duties apply immediately to all imports of subject goods, even if your container is mid-ocean.
Provisional duties are not estimates. They are the floor. When CBSA issues the final determination, the margin can go up. You pay the difference retroactively, plus interest. If the final margin is lower, CBSA refunds the delta, but refund processing takes months, and you've already paid the higher amount at release.
Margins are exporter-specific. One Chinese steel mill might face a 46.7% anti-dumping duty while another gets 89.2%. If your supplier is not individually assessed, you pay the all-others rate, which is typically the highest margin in the case. Switching suppliers mid-case does not exempt you unless the new exporter successfully applies for their own margin determination, a process that takes a year or more.
How Anti-Dumping Duties Hit Your CAD Filing and CARM Workflow
When you file a Commercial Accounting Declaration for goods under a SIMA order, you declare the HS 6-digit classification, the SIMA case number, and the manufacturer or exporter name. CBSA's system matches the exporter to the applicable margin and calculates the duty. If the exporter is not in the system, the all-others rate applies automatically. There is no manual override.
For release prior to payment, your RPP bond must cover the full SIMA exposure in addition to MFN tariffs, GST, and any other charges. If you import CAD 500,000 per month of subject goods with a 60% anti-dumping margin, your bond floor rises by CAD 300,000. Most brokers recalculate RPP security quarterly based on your rolling import mix. If you add a new product line that falls under an active SIMA case and do not update your bond, CBSA suspends release privileges and forces you to pay duties in full at the border until the shortfall is covered.
Warehouse Timing and Inventory Strategy Under SIMA Orders
Goods that entered Canada and were reported to CBSA before a SIMA provisional or final duty effective date are not subject to the measures. But the moment you file the CAD to release them into commerce after the order date, the duty applies. If you run a sufferance warehouse program and a SIMA case drops mid-quarter, you have a narrow window to release existing inventory before the duty kicks in. Timing a release to clear before the effective date can save five or six figures on a full container load of subject goods.
Once the order is in force, your inventory planning changes. Some importers shift to smaller, more frequent shipments to minimize duty exposure on any single entry. Others consolidate and pay the margin once rather than spreading it across multiple CADs. Either way, your landed cost structure is no longer predictable, and your freight forwarding and warehousing cadence has to adjust.
Recent SIMA Cases That Changed Importer Behavior Overnight
CBSA's SIMA registry lists over 150 active orders. Recent cases that moved the cost needle for mid-market importers:
- Gypsum board from the U.S. and nine other countries (2022): Margins ranged from 12.7% to 276.8%, depending on the producer. Drywall distributors importing for Q4 construction projects saw landed costs double on specific SKUs.
- Certain aluminum extrusions from China (renewed 2020): AD margins of 23.9% to 97.8%, plus CVD margins of 1.8% to 7.2%. If you import aluminum profile for window or door frames, this case is still live.
- Concrete reinforcing bar from multiple countries (2017, renewed 2023): Margins vary by mill, but the all-others rate for Chinese rebar sits above 100%. Infrastructure contractors importing rebar for municipal projects had to rewrite their cost stacks mid-bid.
Each of these cases went from complaint to provisional duties in under four months. If you were not monitoring the CBSA SIMA bulletin or your broker was not tracking it for you, your first signal was a CAD summary showing a margin you did not budget for.
What You Can Do Before a Case Lands
You cannot predict which product category CBSA will investigate next, but you can build a buffer. Run a quarterly audit of your import mix by HS code and country of origin. Cross-reference it against the active SIMA registry. If you import goods from a country that is frequently subject to trade remedy cases—China, South Korea, Vietnam, certain EU member states—assume a case could open and model the impact of a 50% to 100% margin on your landed cost.
For high-volume SKUs, consider dual sourcing from CUSMA or CETA origin countries where applicable. A gypsum board importer sourcing from the U.S. pre-2022 could have shifted to Canadian or Mexican supply under CUSMA and avoided the SIMA margin entirely. Diversification does not eliminate risk, but it limits single-case exposure.
If a provisional duty notice drops and your goods are in transit, contact your broker immediately. You have options—paying the provisional amount and claiming a refund if the final margin is lower, posting separate security to defer payment, or in rare cases applying for a product exclusion if your goods are not subject goods under the case definition. All of these require fast CBSA verification and CAD amendments. Waiting until the container hits the port is too late.
SIMA Filing and AMPS Penalties If You Get It Wrong
Misclassifying subject goods or misrepresenting country of origin on a CAD to avoid anti-dumping duties is not a clerical error. It is a Customs Act section 32.2 contravention under the Administrative Monetary Penalty System. First-time penalties for minor infractions start at CAD 400. Deliberate misclassification or repeated contraventions trigger Level 3 or Level 4 penalties, which can reach CAD 25,000 per entry. CBSA also has the authority to seize goods and suspend your importer account if the misrepresentation is deemed willful.
If you are unsure whether your goods fall under an active SIMA case, file the CAD with the SIMA case number and exporter details and let CBSA make the determination. It is better to overpay and claim a refund than to underreport and face an AMPS assessment during a post-release CBSA verification.
We file CADs against active SIMA orders every week. If your import profile includes any of the 150+ product lines under measures, or you're bringing in goods from countries with frequent trade remedy exposure, we should probably run the numbers together. Get in touch.
Frequently Asked Questions
What triggers a SIMA anti-dumping investigation in Canada?
A Canadian industry files a complaint with CBSA alleging that imports are being sold below normal value and causing material injury. CBSA has 105 days from complaint receipt to decide whether to open a formal investigation, per the Special Import Measures Act. If the evidence threshold is met, provisional duties apply immediately.
How does CBSA calculate anti-dumping duty margins?
CBSA compares the export price to Canada against the normal value in the exporter's home market or a surrogate country. The margin is the difference, expressed as a percentage or specific dollar amount per unit. Margins are exporter-specific—one Chinese steel producer might face a 46.7% margin while another gets 89.2%, as seen in the 2022 gypsum board case.
Do anti-dumping duties show up in my CAD filing?
Yes. When you file a Commercial Accounting Declaration through the CARM Client Portal for subject goods, you declare both the HS 6-digit classification and the applicable SIMA case number. CBSA's system auto-applies the margin tied to the manufacturer. If the exporter isn't listed, you pay the all-others rate, which is usually the highest margin in the case.
Can I get release prior to payment if my goods are under a SIMA order?
Yes, but your RPP bond must cover the full anti-dumping and countervailing duty exposure in addition to regular tariffs and GST. If you're importing CAD 500,000 per month of subject goods with a 60% AD margin, your bond floor rises accordingly. Most brokers recalculate quarterly based on your import mix.
What happens to inventory already in a Canadian bonded warehouse when a SIMA order is issued?
Goods that entered Canada and were reported to CBSA before the provisional or final duty effective date are not subject to the SIMA measures. But the moment you file the CAD to release them into commerce after the order date, the duty applies. Timing your sufferance warehouse release can save five or six figures on a container load.
How long does a SIMA anti-dumping order stay in force?
Five years from the date of the final determination. The Canadian International Trade Tribunal reviews the order before expiry. If the domestic industry demonstrates that injury would resume without the measures, the order is extended for another five years. Some cases have been renewed multiple times since the 1990s.
Can I avoid anti-dumping duties by routing through a third country?
No. CBSA tracks country of origin, not country of export. If the goods were manufactured in China and a SIMA order covers Chinese origin, shipping them via Vietnam or the U.S. does not exempt you. Misrepresenting origin on the CAD triggers AMPS penalties under Customs Act section 32.2, starting at CAD 400 for a first minor infraction and scaling to CAD 25,000 for deliberate misclassification.
