Three of the most influential voices in the digital-asset industry — Grayscale, Andreessen Horowitz (a16z), and the Crypto Council for Innovation (CCI) — have jointly urged the Securities and Exchange Commission (SEC) to resist imposing sweeping restrictions on novel exchange-traded products (ETPs), warning that a blanket regulatory approach risks stifling product innovation and undermining the regulatory clarity the industry urgently needs.
The coordinated effort represents a significant mobilization of both asset-management expertise and venture-capital influence in a single push against what the industry regards as regulatory overreach. The coalition's central demand is straightforward but consequential: the SEC should preserve its existing classification rules for exchange-traded products rather than collapse novel instruments into a single, undifferentiated regulatory category subject to heightened blanket restrictions.
Why Classification Matters
At stake is the architecture of how digital-asset ETPs are reviewed, approved, and ultimately brought to market. The crypto industry's concern is that treating every novel exchange-traded product as belonging to a single class — regardless of its underlying asset, structure, or risk profile — would impose an inappropriate one-size-fits-all standard that ignores the meaningful distinctions between product types. Grayscale, which has navigated the SEC's approval process firsthand in its long-running effort to convert its Bitcoin trust into a spot exchange-traded fund (ETF), understands the practical consequences of regulatory categorization better than most market participants.
A blunt regulatory instrument applied across the entire spectrum of novel ETPs would, in the industry's view, create unnecessary friction without commensurate investor protection gains. Different asset classes, different custody arrangements, and different liquidity profiles warrant differentiated regulatory treatment — a principle the existing classification framework, whatever its imperfections, was designed to reflect.
The Case for Faster, Clearer Reviews
Beyond opposing blanket restrictions, the three organizations have gone further by affirmatively proposing alternative pathways designed to produce both clearer regulatory outcomes and faster review timelines. This constructive posture is deliberate. By presenting the SEC with workable solutions rather than simply objecting to proposed constraints, Grayscale, a16z, and the CCI are attempting to reframe the conversation from adversarial to collaborative — positioning themselves as partners in building a functional regulatory regime rather than obstacles to investor protection.
The specific routes proposed by the coalition have not been detailed in full public disclosure, but their direction is clear: streamline the review process in ways that give product sponsors predictable timelines and clearer standards, while preserving the SEC's ability to scrutinize genuinely novel structures on their individual merits. This is a materially different proposition from accepting slower, more opaque, and more uniform review processes that a blanket novel-ETP category would likely produce.
A Unified Industry Front
The composition of the coalition is itself noteworthy. Grayscale brings direct experience as an asset manager operating regulated crypto products at scale. a16z contributes the perspective of one of Silicon Valley's most influential venture capital firms, with deep portfolio exposure to blockchain infrastructure, decentralized finance (DeFi) protocols, and digital-asset exchanges. The CCI represents a broader cross-section of the crypto industry, lending the initiative a trade-association legitimacy that amplifies the signal beyond any single commercial interest.
Together, the three parties present a front that is difficult for the SEC to dismiss as narrow self-interest. Their argument — that preserving granular classification is better for investors, markets, and regulatory coherence than a blunt categorical approach — is supported by the full weight of their combined expertise and market knowledge. It also arrives at a moment when the SEC is navigating intense political and judicial pressure over its approach to digital-asset regulation more broadly, making the agency's receptiveness to industry input potentially greater than at any prior point in the crypto ETF debate.
What This Means for the Market
The outcome of this regulatory engagement will have tangible consequences for the pipeline of digital-asset ETPs awaiting review. If the SEC adopts a blanket restrictive framework for novel products, sponsors of next-generation crypto ETFs — instruments tracking assets beyond Bitcoin and Ether, or employing novel structures such as actively managed crypto strategies — face the prospect of longer delays, higher compliance costs, and greater uncertainty about approval prospects. Conversely, if the SEC heeds the coalition's argument and preserves differentiated classification alongside faster review mechanisms, it could unlock a new generation of regulated crypto investment products for retail and institutional investors alike.
The engagement also signals that the crypto industry's most sophisticated actors are no longer content to react to regulation after the fact. By engaging proactively, proposing concrete alternatives, and coordinating across asset managers, venture capital, and trade bodies, they are attempting to shape regulatory architecture from the inside — a maturation in strategy that reflects hard lessons learned from years of regulatory uncertainty. Whether the SEC accepts their framing remains to be seen, but the industry has clearly decided that silence is no longer a viable posture.
