The European Commission has moved to extend its most stringent tier of digital regulation to three of the internet's most recognisable platforms, formally designating ChatGPT, Reddit, and Roblox as either Very Large Online Platforms (VLOPs) or Very Large Online Search Engines (VLOSEs) under the Digital Services Act (DSA). The trigger is straightforward and unambiguous: each platform has surpassed 45 million monthly active users within the European Union, the statutory threshold above which the DSA's most demanding obligations automatically apply. The designations mark a significant expansion of the EU's regulatory perimeter, bringing an artificial intelligence assistant, a major social news aggregator, and a globally dominant gaming metaverse simultaneously within the same enforcement framework.
Why the 45 Million User Threshold Matters
The 45 million monthly active user benchmark is not arbitrary. It was calibrated by Brussels legislators to capture roughly ten percent of the EU's population — a figure designed to identify platforms whose scale gives them systemic influence over public discourse, information access, and potentially financial markets. When a platform crosses that line, it ceases to be treated as a standard online service and instead assumes the responsibilities of a quasi-public infrastructure operator. Content moderation transparency, algorithmic accountability, data access for independent researchers, risk assessments for societal harms, and independent audits all become mandatory rather than voluntary. The stakes for non-compliance are severe: fines can reach six percent of a company's global annual turnover, with the Commission retaining the power to impose temporary bans on services in the most egregious cases.
Three Very Different Platforms, One Regulatory Logic
The breadth of this latest wave of designations is notable precisely because the three platforms are structurally dissimilar. ChatGPT, developed by OpenAI, is a generative artificial intelligence product whose interactions are conversational and highly personalised — raising distinct questions around the amplification of misinformation, the opacity of AI-generated outputs, and the recommendation mechanics that shape what information millions of European users receive. Reddit, the long-running American social news and discussion aggregator, has spent years navigating content moderation controversies and has already faced scrutiny from regulators in multiple jurisdictions over the volume and velocity of user-generated material on its forums. Roblox, meanwhile, occupies an unusual space as a gaming and user-generated metaverse environment with a disproportionately young user base, making child safety provisions and exposure to potentially harmful content a particular regulatory focal point.
Despite these differences, the Commission's designation logic is consistent: scale creates systemic risk, and systemic risk demands systemic oversight. The DSA framework does not distinguish meaningfully between platform types at the VLOP or VLOSE tier — it imposes a common floor of obligations that each company must then operationalise according to the specific character of its service.
A Maturing Regulatory Architecture
These new designations arrive as the DSA framework moves from its initial rollout phase — which covered the first cohort of large platforms including Meta, Google, and TikTok — into a phase of ongoing expansion as more platforms accumulate sufficient European user bases to cross the threshold. The architecture reflects a deliberate legislative choice: rather than naming specific companies in the statute and risking rapid obsolescence, the DSA uses a dynamic, data-driven designation process. Platforms self-report their user numbers every six months, and the Commission retains the right to conduct its own assessments where self-reported data appears incomplete or unreliable.
This rolling designation mechanism means the current cohort of three is unlikely to be the last. As AI-driven services proliferate and gaming environments become more deeply embedded in daily European life, the Commission has signalled that it will continue to evaluate which products are approaching or exceeding the statutory threshold. For compliance and legal teams across the technology sector, the message is clear: user growth in Europe is no longer purely a commercial milestone — it is a regulatory trigger.
What This Means for Platforms and Markets
For OpenAI, whose ChatGPT product now enters the EU's most demanding oversight tier, the designation adds a layer of regulatory complexity to an already fraught European expansion. The company will be required to conduct and publish risk assessments addressing how its AI outputs could affect public health, electoral integrity, and fundamental rights — obligations that have no direct equivalent in its home market of the United States. For Reddit, which completed its initial public offering in 2024 and now answers to public shareholders, the cost and operational burden of DSA compliance becomes a material consideration in its European operating model. Roblox, whose core audience skews younger than most major platforms, will face particularly pointed scrutiny around how its systems protect minors from harmful content and predatory behaviour.
Across all three, the immediate practical requirements include appointing EU-based legal representatives, establishing complaint-handling mechanisms accessible to European users, granting data access to vetted researchers, and submitting to the annual independent audit cycle. These are not trivial undertakings, and the compliance infrastructure required — legal counsel, technical data pipelines, internal risk functions — represents a meaningful cost that smaller organisations would struggle to bear. That burden is by design: the DSA's architecture uses compliance cost as an implicit scaling mechanism, ensuring that the heaviest obligations land on those with the greatest capacity to meet them.
The European Commission's decision to formally designate ChatGPT, Reddit, and Roblox signals that the DSA is operating precisely as intended — expanding dynamically as the platform economy evolves, and refusing to leave influential digital environments in a regulatory grey zone simply because they arrived after the initial wave of designations. For the broader technology and financial services industries watching from the sidelines, the precedent is unambiguous: in Europe, scale carries accountability.
