UK Graduate Visa 2026: Section 3C Leave, Share Code States, and the Follow-Up Date Problem HR Teams Ignore

The Graduate visa is technically the simplest UK work authorisation category: no sponsor, no salary floor, open conditions. Two years for bachelor's and master's graduates, three for PhDs. For HR and compliance teams, it should be the cleanest case to handle. In practice, it generates more confusion at onboarding than almost any other route — usually because the transition from Student visa creates transient states that most HR systems don't model correctly.

Here's the actual logic, stage by stage.

Stage 1: The pending-application state

When a student applies for the Graduate visa, their Student visa remains in force under section 3C leave. During this window — which typically lasts less than 10 days but can extend if biometric appointments are delayed — their share code returns Student status with work restrictions attached.

If you run a right-to-work check on a new hire in this state, you'll see:

• Immigration status: Student
• Work conditions: Permitted (20 hours/week during term time)
• Visa expiry: [Student visa expiry]

This is not a failed check. The correct action is to record the application reference number and payment confirmation, note in your HR system that a Graduate application is pending, and set a reminder to re-run the share code check once the new visa is confirmed. Do not refuse to hire on this basis. Do not delay the start date until the Graduate visa appears in the system. Both actions create exposure, and neither is required by the Home Office guidance for employers.

Stage 2: The granted state

Once the Graduate visa is granted — usually within 5 working days of the biometric appointment — the share code updates to reflect:

• Immigration status: Graduate
• Work conditions: No restrictions
• Expiry: [Grant date + 2 years, or + 3 years for PhD holders]

Run your right-to-work check at this point. Record the expiry date explicitly. Set a follow-up date in your HR system at 90 days before expiry. This is not optional if the person is still employed when the visa expires — employing someone without valid right-to-work status carries a civil penalty of up to £60,000 per worker from February 2024, and repeat breaches result in criminal liability.

Stage 3: The follow-up date failure

This is where most compliance failures happen — not at the point of hire, but months or years later. The initial check is done, the expiry date is noted somewhere, and then nobody revisits it. Staff turn over in the HR team. The spreadsheet is lost. The reminder doesn't fire.

Graduate visas expire. Unlike indefinite leave to remain or British citizenship, they have a hard end date. If the employee hasn't switched to a new route (Skilled Worker, Global Talent, family, etc.) by that date, they no longer have the right to work, and you as the employer are the responsible party.

The Home Office employer checking service returns real-time status. Running the check again near expiry gives you a live view of whether the visa has been renewed or switched. But you have to actually run it — the system doesn't push alerts to employers.

At scale, third-party tools that wrap the employer checking service API and push expiry alerts to HRIS platforms are worth the cost. At lower headcounts, a calendar entry per employee tied to the visa expiry date is the minimum viable control.

Stage 4: The switch to Skilled Worker

A meaningful proportion of Graduate visa holders switch to Skilled Worker during their open-work window, usually when they've found a role with an employer who holds a sponsor licence. This changes their visa category and expiry date. What that means for you as their employer depends on whether you are that sponsor.

If your company is sponsoring the Skilled Worker visa: you need to issue a Certificate of Sponsorship, confirm the role meets the current SOC code requirements and going rate, and run a fresh right-to-work check once the new visa is granted.

If a different employer is sponsoring: your right to employ them under the Skilled Worker route doesn't transfer. You would need to become the sponsor, or they'd need to remain on the Graduate visa (if it hasn't expired) while working for you.

One edge case that frequently surprises HR teams: an employee switches from Graduate to Skilled Worker with another employer while still on your payroll. Their right to work with your organisation after that point depends on whether their Graduate visa was still live at the time of the switch and whether they're now relying on the Skilled Worker visa exclusively. This needs to be checked, not assumed.

The sponsor licence check step

Before starting any Skilled Worker sponsorship process, confirm that your company holds a current sponsor licence in the correct tier.
